The act of intentionally or recklessly discharging a firearm at an aircraft, including helicopters, in flight or on the ground, posing a significant risk to public safety and aviation security.
If the aircraft was occupied: Additional 25 months and $5,000 fine.
If the act resulted in injury or death: Additional charges such as Attempted Murder, Manslaughter, or Murder may apply.
If the aircraft was law enforcement or emergency services: Additional charges such as Terrorism or Attempted Murder of a Public Servant depending on intent, may apply. under offenses against public safety
